General Business Conditions
- The following General Business Conditions (“GBCs”) apply to an offer which you made to Deutsche Lufthansa AG, Flughafen-Bereich West, D-60546 Frankfurt am Main ("Lufthansa") to make use of the option of an upgrade ("Upgrade") of the Economy Class flight you originally bought from Lufthansa to Premium Economy Class or to Business Class as well as the option of an Upgrade of the Premium Economy Class flight you originally bought from Lufthansa to Business Class as well as the option of an Upgrade of the Business Class flight you originally bought from Lufthansa to First Class. Offers can only be made for certain Lufthansa flights and are subject to the condition that the passenger is in possession of an Economy Class ticket or a Premium Economy class ticket or a Business Class ticket, respectively, issued for the requested flight. Offers for tickets sold in India or Japan cannot be accepted.
- Anyone submitting an offer must have reached the legal age applicable in their country of residence at the time they submit their offer. They are deemed to be authorized to act on behalf of the person(s) named or recorded in the offer and to bind such persons(s) to these GBCs with mandatory effect.
- Any offer that you make in connection with booking a flight by Lufthansa, be it addressed directly to Lufthansa or transmitted to Lufthansa by another route, entitles the person(s) named in the offer to be considered for an Upgrade on the basis of these GBCs. If the original flight booking lists more than one passenger, the Upgrade offer applies to each passenger. The offered amount is multiplied by the number of persons named in the original flight booking. Before you are called upon to enter your credit card data, you will see the total amount for the Upgrade.
- Lufthansa has no duty to accept your offer. Accepting your offer is entirely at Lufthansa's discretion.
- You agree that your offer remains valid for Lufthansa to accept at all times up to 48 hours prior to the scheduled departure. Until such time as Lufthansa has accepted your offer, you may amend or cancel your offer (max. up to 72 hours before departure). As soon as Lufthansa has accepted your offer, you have an obligation to pay the full price named in your most recent offer, and are no longer entitled to rescind the Upgrade, except for the reasons stated in these GBCs.
- In the event that Lufthansa cancels the flight and rebooks you to another flight, any offer made in connection with the original booking may be transferred to the new flight or the new flights, provided that seats are still available in the higher service class (Premium Economy Class, Business Class, or First Class, respectively). If, for any reason, not enough seats are available in the higher service class to fulfill your Upgrade (and provided your original offer was accepted), any amount you have paid for the Upgrade will be refunded to the credit card which was used in payment of the Upgrade. The refund amount is offset against any compensation prescribed by law. If you are rebooked for a flight that is not handled by Lufthansa, Lufthansa cannot assume any guarantee of an Upgrade to a higher class. In such a case, the amount you have paid for the Upgrade - applying the above arrangements - is refunded to the credit card which was used to pay for the Upgrade.
-
Lufthansa may accept your offer at any time during a period up to 48 hours before the scheduled departure. If Lufthansa accepts your offer, your credit card is charged the full amount immediately, and Lufthansa will issue an Upgrade for all passengers in your original booking. The total amount charged contains all taxes due and payable in advance and any fees for the Upgrade. Excepted from this are
(a) possible extra costs for using your credit card abroad as a result of the Plusgrade service being handled by the service provider Plusgrade L.P. with registered office in Canada;
(b) possible foreign exchange fees that you may incur if you make your offer in a currency that is not the same as that of your credit card account.
Whether and in what amount extra costs are charged for this depends on your credit card agreement. Information on this may be obtained from the credit card-issuing bank.An Upgrade already issued by Lufthansa cannot be transferred - either partially or in its entirety - to another person or to another flight, except for the reasons named in item 6 of these GBCs.
-
As soon as your offer has been accepted by Lufthansa, no refund, crediting or exchange whatsoever is possible. Excepted are the following conditions:
- The flight for which your offer was accepted and for which you have received an Upgrade was cancelled.
- The flight for which your offer was accepted and for which you have received an Upgrade was cancelled, and Lufthansa has rebooked you for another flight, though in the service class of your original booking.
- Your offer was accepted and you received an Upgrade, but you were unable to obtain a seat in the service class of the Upgrade for reasons for which Lufthansa is answerable. These include, inter alia, changes to the fixtures and fittings or a delay in a connecting flight which meant that you missed the flight for which you received the Upgrade.
- If a refund is permissible, it is made in that currency in which the Upgrade amount was charged. If, in making a refund in the currency of the originally charged Upgrade amount, an exchange rate is employed, the rate used is the generally accepted, prevailing rate. This exchange rate can be adjusted to take account of conversion fees and other levies that Lufthansa may charge. On no account can the refund amount be higher than the amount charged for the Upgrade in the original currency.
- The fare conditions of the ticket that you originally bought retain their validity, even if your offer of an Upgrade was accepted.
- Lufthansa assumes no guarantee that passengers who have received an Upgrade can be allocated specific seats.
- In addition to these GBCs, the above arrangements are subject to the General Terms and Conditions of Carriage (GCCs) in their variously applicable versions. These are available at lufthansa.com and are expressly defined as being constituent parts of these GBCs.
